Terms of Use

These terms govern use of fiberplans.info. By reading the site you accept them. If you do not, the remedy is simple: stop reading.

1. The agreement

This agreement is between you and FiberPlans, the publisher of this website. It takes effect when you first load a page and continues while you use the site. No account, registration or payment is required on either side.

2. Use of the site

You may read, print and quote from these pages for personal and editorial use. You may link to any page. You may not republish a guide in full, mirror the site, or present its analysis as your own without written permission.

3. Intellectual property

All editorial text, tables and site design are the intellectual property of FiberPlans and are protected by copyright. Photographs are used under the licences recorded in each image’s metadata, and those licences travel with the image. Trademarks and provider names belong to their owners and are used here for identification and commentary only.

4. Editorial content, not advice

Every guide is analysis of published documents. Nothing on this site is legal, financial or consumer advice for your particular circumstances, and nothing here is a recommendation to enter or leave a contract. Decisions about a contract are yours, taken with the documents in front of you.

5. Accuracy and corrections

Reasonable care is taken to read source documents correctly and to date each guide. Contracts change, and a page that was right in March may be wrong in October. Corrections are published when they are found, but no warranty of accuracy or completeness is given, and no liability is accepted for a decision taken on the strength of an outdated page.

6. Third party links and affiliate disclosure

Links to providers and regulators are offered for verification. Some outbound links may carry a referral parameter, which may generate a commission if a reader signs up. That possibility is disclosed wherever it exists and never determines the content of a guide, a table or a ranking.

7. User submissions

If you send a correction, a document or a comment, you confirm it is yours to send and grant FiberPlans a non-exclusive right to quote or paraphrase it in editorial content. Personal details are removed before any such use. You keep ownership of what you send.

8. Prohibited conduct

You may not scrape the site at a rate that degrades it, attempt to access administrative areas, inject code, use the contact address for bulk unsolicited mail, or republish excerpts in a way that misrepresents what a guide says.

9. Privacy

Personal data is handled as described in the privacy policy, which forms part of these terms. Where the two documents appear to conflict on a data question, the privacy policy governs.

10. Disclaimer of warranties

The site is provided as is and as available. To the fullest extent permitted by law, all warranties are disclaimed, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. No warranty is given that the site will be uninterrupted, error free, or free of harmful components.

11. Limitation of liability

To the fullest extent permitted by law, FiberPlans is not liable for indirect, incidental, special or consequential damages, nor for lost profits, lost savings, or the cost of a contract entered on the basis of a page read here. Where liability cannot be excluded, it is limited to the amount you paid to use the site, which is nothing.

12. Indemnification

You agree to indemnify and hold harmless FiberPlans and its contributors against claims, losses and reasonable legal costs arising from your misuse of the site, your breach of these terms, or your infringement of a third party right.

13. Confidentiality

Correspondence sent to the contact address is treated as confidential in the sense that it is not published or passed to third parties, except where a correction requires naming a provider document. Anything you need to remain private should be marked as such in the message.

14. Termination

Access may be withdrawn, and these terms terminate, if the site is closed, if conduct in section eight is repeated, or if continuing to serve a reader becomes impractical. Sections on intellectual property, liability, indemnification and governing law survive termination.

15. Governing Law

These terms are governed by the laws of the jurisdiction in which the publisher is established, without regard to conflict of law rules. Nothing in this clause removes a consumer protection right you hold in your country of residence that cannot be waived by agreement.

16. Dispute resolution and binding arbitration

Before any formal step, write to the contact address and describe the dispute; most issues resolve at that stage. If a dispute is not resolved within thirty days, it will be settled by binding arbitration on an individual basis, before a single arbitrator, in the language of the site. Each side bears its own costs unless the arbitrator decides otherwise. Class actions and representative proceedings are waived to the extent the law permits.

17. Changes to these terms

The terms may be revised when the site changes. The version published on this page is the one in force, and continued use after a revision constitutes acceptance of it.

18. Contact

Questions about these terms go to [email protected]. That is also the address for permission requests and for corrections.
